A series of questions have arisen related to the U.S. Supreme Court's recent decision in Janus v. AFSCME Council 31. After a summary of the decision, answers to those questions are set forth below.

The questions and responses involve the rights of union members and non- members. It should be noted that these responses are general in nature; specific questions raised in a particular situation implicate different state public-sector labor laws, varying collective-bargaining agreements, the specific facts involved, and the constitutions and by- laws of the various Locals. As such, IAFF Locals should consult, in the first instance, with their local counsel before taking any actions in response to Janus, especially actions affecting non-members.
